Terms of Service

Research use onlyNot therapeutic goodsISO/IEC 17025

In these Terms, "Services" means the analytical testing we perform on samples you send us; "peptester", "we" and "us" mean the issuing entity named below; and "Customer" or "you" means the person or organisation submitting a sample. By ordering, you agree to these Terms as they stand at the time of your order.

Nature of the Services

peptester provides independent laboratory analysis of samples submitted by the Customer, measuring analytical characteristics such as identity, purity, quantity and elemental contaminants. We are a testing service only. We do not manufacture, compound, supply, sell, distribute, import or promote peptides or any other substance.

Research use only; not therapeutic goods

All Services, samples and certificates relate to substances handled strictly as research chemicals and laboratory reference materials. Nothing we test, report or issue is a therapeutic good, medicine, medical device, food or cosmetic, and nothing is intended, supplied or approved for human or animal administration or clinical use. A peptester certificate is not an approval, registration, listing or endorsement under the Therapeutic Goods Act 1989 (Cth), by the Therapeutic Goods Administration (TGA), or by any regulator, and must not be represented as such.

No medical or therapeutic advice or recommendations

Our certificates and communications are factual analytical data only. We do not provide, and nothing we supply constitutes, medical, pharmaceutical, health, dosing or therapeutic advice, or any recommendation to acquire, use, administer or consume any substance. You must not rely on our results to make any health or treatment decision. Always consult a suitably qualified professional.

The sample as received

Results apply only to the specific sample, in the condition and quantity received by our laboratory at the time of testing. They are not representative of any other unit, batch or lot, or of the same sample at any other time, and say nothing about manufacturing, storage, provenance, stability or future condition. We test the material you send; we do not verify its origin, legality, or how it was represented to you.

Measurement uncertainty and tolerances

All analytical measurement carries inherent uncertainty. Even sophisticated laboratory molecular instrumentation (including HPLC, LC-MS/MS and ICP-MS) operates within a recognised tolerance, and reported values typically carry a deviation of approximately 1% to 2%, and in some methods more, depending on analyte, matrix and concentration. Reported figures are estimates within method uncertainty, not absolute or guaranteed values, and any pass or fail statement is made against the stated specification within that uncertainty. Minor variation within tolerance is expected and is not an error or defect.

No warranty

To the maximum extent permitted by law, the Services and results are provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose, merchantability, or accuracy beyond the stated method uncertainty.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability can be limited, it is limited, at our option, to re-supplying the Services or paying the cost of re-supply.

Limitation of liability

To the maximum extent permitted by law, peptester is not liable for any indirect, incidental, special or consequential loss, or for any loss or damage (including personal injury, illness, death, economic or property loss) arising from your or any third party's use of or reliance on our results, your handling, shipping, storage or use of any sample, or any decision to acquire, use or consume any substance. Our total aggregate liability in connection with the Services is capped at the fees paid for the relevant test.

Indemnity

You indemnify and hold harmless peptester and its personnel against all claims, liabilities, losses, penalties and costs (including legal costs) arising from your breach of these Terms, your samples, your use or distribution of our results, any misrepresentation of a certificate, or your breach of any law.

Your responsibilities and warranties

You warrant that you are legally entitled to possess, package, ship and submit each sample, that doing so breaches no law, and that you will comply with all applicable laws and carrier rules. You must not use our Services, name or certificates to market, label or imply that any substance is safe or suitable for human or animal consumption or for any therapeutic use.

Integrity of certificates

Certificates may be shared only in unaltered, complete form. You must not edit, forge, selectively reproduce or misrepresent a certificate or its scope. We may verify, suspend or invalidate any certificate, and we cooperate with regulators and law enforcement as required by law.

Confidentiality

We identify samples by reference number and do not publish who submitted a sample. We handle your information in line with our privacy practices and may disclose it only where required by law or a regulator.

Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.

Changes to these Terms

We may update these Terms at any time. The version in effect when you place an order applies to that order. Continued use of the Services means you accept the current Terms.
